Efficiently/effectively manages the daily activities of the Office of the Prosecutor with professional level legal knowledge and skill in representing the Nation’s interests in legal research, motion practice, court and jury trials and appeals.
Knowledge/Skills: • Knowledge of the Fort McDowell Yavapai Nation’s Constitution, Law and Order Code, Code of Criminal Procedure, Tribal Case Law, Federal Criminal Code and Rules, Federal Indian Law, Indian Civil Rights Act, Indian Child Welfare Act, Federal Rules of Criminal Procedures, Arizona Revised Statutes • Knowledge of Tribal Court protocol, proceedings, and practices; • Knowledge of and experience using legal research tools. • Knowledge of and compliance with of the ABA Model Rules of Professional Conduct • Skill in interpreting and applying complex laws, statutes, ordinances, and rules • Skill in managing a diverse case load • Skill in effectively and efficiently managing staff • Skill in establishing and maintaining effective and cooperative working relationships with other departments of the Fort McDowell Yavapai Nation. Minimum Qualifications/Education: 1) Law degree from an accredited law school and membership in good standing in the State Bar of Arizona. 2) Five years or more of experience as a practicing attorney with administrative/management and/or supervisory responsibilities. 3) Tribal or other governmental experience is desirable.
Tasks: • Manages the Office of the Prosecutor; • Supervises, assigns and monitors staff work and provides/oversees staff training and competencies; • Ethically represents the Nation in all adult criminal, juvenile, dependency, and appeal actions; • Review police reports and determines whether and what charges should be filed; oversees charging decisions of deputy prosecutors • Prosecutes and/or oversees prosecution of all cases from charging through trial and/or appeal • Prepares, presents, and manages the department budget and monitors expenditures; • Oversees and approves purchasing and procurement for department • Oversees and monitors the compliance of any department grants • Cooperatively works with other departments and Tribal Council to achieve the Nation’s strategic goals, including participating is various committees; and • Performs other duties as assigned or required.
