General Summary
The Fort Sill Apache Gaming Commission (“FSAGC”) regulates gaming conducted on Fort Sill Chiricahua Warm Springs Apache Tribal land. The FSAGC seeks legal representation to assist in an ongoing project to amend the Tribe’s Gaming Ordinance. The FSAGC already undertook an intensive internal review of the current Ordinance. The FSAGC now seeks legal services to further refine the Ordinance to ensure compliance with federal law and current gaming trends. Importantly, through this revision, the FSAGC intends to draft an ordinance accessible to patrons, vendors, and all those regulated by it. Attorneys and law firms barred, and in good standing, in any state or U.S. jurisdiction may apply. Experience in Indian gaming and tribal code drafting, specifically tribal gaming ordinances, is required. Additionally, knowledge of the Oklahoma-Tribal Gaming Compact is preferred. Indian preference will be applied to the selection process. Proposals must be received by the FSAGC no later than 4:30 p.m. on March 30, 2026. Proposal Content and Submission Process
A proposal must contain: A. Legal Experience. A description of the relevant legal experience in advising tribal gaming commissions and drafting tribal gaming ordinances. The description should include the names, addresses, and contact information of at least three clients. B. Practice or Firm Information. A description of the offeror’s organization, structure, and areas of practice. The description should indicate if the firm is a small or Indian-owned business. C. Attorney Qualifications. A description of the qualifications of the attorney(s) who will provide the legal services. The description must detail how the work will be supervised, if applicable. D. Price. A description of the hourly billing rates of each attorney or other legal staff who is expected to work on this project. And a description of any charges for expenses, if any, including legal research, for example. E. Insurance. Provide a statement that the offeror will maintain comprehensive liability, professional liability, and workers’ compensation insurance on all staff assigned to this project.

Evaluation Criteria & Selection The FSAGC will evaluate the proposals based on the following criteria: A. Legal Experience; A. Indian gaming knowledge B. Attorney Qualifications C. Price D. Quality of Proposal; and E. Indian Preference.
The FSAGC will review the proposals and schedule 30-minute virtual interviews by April 7, 2026.
All interviews will be held on April 23, 2026. The FSAGC will notify the selected legal counsel by April 24, 2026. The FSAGC intends to begin this project by May 15, 2026. And again, the FSAGC’s goal is to complete this project by July 9, 2026.
Scope of Work
The selected legal counsel will work under the FSAGC’s direction. Upon selection, the selected legal counsel will first meet with the FSAGC virtually and then independently review the current draft Ordinance. After their independent review, the selected legal counsel will collaborate with the FSAGC to complete a final draft to recommend to the Fort Sill Chiricahua Warm Springs Apache Business Committee for enactment. The FSAGC’s goal is to complete this project by July 9, 2026. In completing this work, the selected legal counsel will provide the FSAGC monthly detailed invoices billed at their hourly rate (if any). The FSAGC is open to reasonable attorneys’ fees.
