ESSENTIAL DUTIES AND RESPONSIBILITIES: 1. Conducts all survey work required to meet the needs of the Lands Division and the Southern Ute Indian Tribe, defined by the Lands Division. 2. As a licensed Professional Land Surveyor, conducts surveys and prepares plats which conform to the Colorado laws regulating the practice of land surveying under the following conditions: • The survey involves the boundary between Southern Ute Tribal and fee land. • The survey involves private land in any way, such as a right-of-way across private land for the Tribe. • The survey involves the establishment or re-establishment of a section corner, 1/4 corner, or 1/16 corner, including filing the monument record with the State of Colo. • Any survey that finds previously unrecorded evidence of an original government survey corner. • The survey involves surveying homesites for Tribal Members. • The survey involves an allotment. 3. When conducting administrative surveys provides complete and detailed plats and other information to the department requesting the survey. 4. Prepares and reviews legal descriptions and other plats as necessary. 5. Responsible for the maintenance, upgrading or replacement of survey equipment belonging to the Tribe. 6. Advises the Lands Division Head on the estimated cost and time required for specific surveys. 7. Maintains complete records on surveys conducted. Keeps track of time spent on each project. 8. Provides information to Tribal departments, Tribal members, and non-members relevant to surveys. 9. Researches and complies information as needed from records maintained by La Plata County, BIA, BLM, private surveyors, and any other sources available. 10. Recognizes the sensitivity of the position as it relates to confidential information pertaining to surveying. 11. While on duty conducts himself/herself in a manner reflecting positively on the Lands Division and the Southern Ute Indian Tribe. 12. Willingly accepts guidance and direction from his/her supervisor and makes changes in performance to comply with that direction. 13. Establishes and maintains an effective working relationship with co-workers, the public and supervisory staff. 14. Performs additional related work as assigned.

Southern Ute Indian Tribe

POSITION SUMMARY: This position conducts all administrative surveys and surveys as a licensed Professional Land Surveyor, needed to meet the needs of the Southern Ute Indian Tribe.

QUALIFICATIONS: Must have a High School Diploma or Equivalent. Must have a Current State of Colorado Professional Land Surveyors License. Must have 6 years of experience in land surveying. Must have 3 years of computer experience with a strong working knowledge of AutoCAD. Must have 3 years of experience creating plats. Must have experience and knowledge of the cadastral surveys in accordance with the Bureau of Land Management methods. Must be able to make clear, concise and effective verbal and written presentations and reports. Must sign confidentiality agreement. Must have valid Driver’s license for state of residency and be insurable under the Tribal Vehicle Insurance Policy. Must pass a thorough criminal history background check and pre-employment drug test. PREFERRED QUALIFICATIONS: Working knowledge of the Southern Ute Indian Reservation boundaries and ownership of land within the outer boundaries of the Reservation. Be C-Fed Certified or capable of becoming certified. TERO preference.

Land Surveyor 

ESSENTIAL DUTIES AND RESPONSIBILITIES: 1. Reviews and submits to the Director for approval Construction Pay Applications, Monthly Work Progress Pay Applications, and Professional Services Invoices. Must be able to understand Schedule of Values and be able to determine whether pay application submittals are accurate reflections of work in progress or work completed. 2. Responsible for tracking project expenditures for both tribally funded and/or federally funded projects to ensure projects stay within budget. 3. Generates purchase orders, requisitions, and check requests for submission to Department Director. 4. Assists the Director with the development and review of Construction Agreement Contracts and Professional Service Agreement Contracts. Works directly with Tribal Attorneys to develop a strong, comprehensive contract that protects the interests of the Southern Ute Tribe. Responsible for ensuring contractors comply with contract specifications. Requires accurately interpreting contract intent. 5. Sets up meetings with contractors, vendors, design professionals, and user groups. Assists with ensuring user group programming goals are being met and that such goals are within budgetary constraints. 6. Assists with the preparation of Tribal Council packets and construction project updates; assists in expediting the flow of information to the Executive Officer and Tribal Council. 7. Assists with the development of scope of services for work to be performed. Requires clear understanding of proposed project goals. 8. Coordinates all phases of engineering, design, testing and construction activities on current construction projects. 9. Assists with the development of Change Orders, Notices to Proceed, work instructions, and requests. 10. Develops project schedules and coordinates project meeting for progress and action-item updates. 11. Writes reports providing appropriate documentation of project status, prepares project correspondence to engineers, contractors and Department Director. 12. Organizes and maintains files, plan sheets and specifications on all construction projects. 13. Attends training as required or requested. 14. Performs other job-related duties.

Project Administrator--Housing and Construction 

ESSENTIAL DUTIES AND RESPONSIBILITIES: 1. Responsible for coordinating the Tribal Transportation Program (TTP) according to requirements of 25 CFR Part 170 and other Bureau of Indian Affairs (BIA) or Federal Highway Administration (FHWA) rules. 2. Develops, revises, and implements policies and standard operating procedures (SOPs) for the Transportation Division 3. Develops and reviews plans, cost estimates, and budgets for road construction projects and maintenance activities. 4. Approves Contractor Pay Applications, Monthly Work Progress Pay Applications, and Professional Services Invoices. 5. Manages and administers the Tribe’s Supplemental Road Maintenance Program 6. Responsible for developing and maintaining spreadsheets tracking Tribal expenditures as well as expenditures for federally funded projects and grants, purchase orders, requisitions, and check requests. 7. Reviews and checks Transportation project related invoices for accuracy and completeness. 8. Responsible for gathering and ensuring that data is entered into the National Tribal Transportation Facility Inventory (NTTFI). 9. Performs and/or facilitates analysis of transportation needs based on feedback from public outreach, current and proposed needs, and system capacity. 10. Approves the development and review of Professional Service Agreement Contracts and Transportation Construction Service Agreement Contracts for review by tribal attorneys. 11. Responsible for development and update of the Long-Range Transportation Plan (LRTP), Tribal Transportation Safety Plan (TTSP), and Tribal Transportation Improvement Plan (TTIP). 12. Develops scopes of work, budgets, and transportation planning-related cost estimates for annual submission of the TTIP. 13. Develops Requests for Proposals, Change Orders, Notices to Proceed, and Scopes of Work. 14. Manages TTP grants and ensures contracts and sub-contracts are executed in compliance with applicable requirements, regulations, and scopes of work for federal funding. 15. Responsible for personnel administration and management including but not limited to recruitment, orientation, training, consistent application of policies and procedures, performance evaluations, disciplinary actions, and terminations. 16. Maintains communications and consults, collaborates, and coordinates with the BIA, Tribal entities, Colorado Department of Transportation (CDOT), and local governments/agencies regarding transportation activities of mutual interest and benefit. 17. Attends transportation planning meetings, including the State Transportation Advisory Committee (STAC) and the Southwest Transportation Planning Region, (SWTPR) as directed and appointed as a voting member by the Executive Officer/Tribal Council. 18. Develops project schedules and coordinates project meetings for progress and action-item updates. 19. Writes and approves reports providing appropriate documentation of project status; prepares project correspondence to consultants, governmental entities, contractors, other professionals, and Department Directors. 20. Performs other job-related duties as assigned.

Provides oversight and management of transportation projects from conception through completion including P.L.93-638 projects.

QUALIFICATIONS: Must have an AA/AS and 5 years of experience in transportation project management, road construction, excavation, civil engineering, or related area OR a BA/BS in Civil Engineering, Project Management, Construction Management or related field and 3 years of experience in transportation project management, road construction, excavation, civil engineering, or related area OR 7 years of experience in transportation project management, road construction, excavation, or civil engineering. Must have 2 years of experience in reading construction plans, developing cost estimates, monitoring construction projects, and inspecting projects. Must have 2 years of supervisory experience. Must have 2 years of experience in the development and administration of budgets. Must have experience in the development and review of agreements and contracts. Must have current computer experience including extensive experience with Microsoft Word and Excel. Must have valid Driver’s license for state of residency and be insurable under the Tribal Vehicle Insurance Policy. Must pass a criminal background check and a pre-employment drug test. PREFERRED QUALIFICATIONS: Experience as a Construction Project Manager for a Federal, State, County, or Municipal transportation department/division. Experience with management of P.L .93-638 Projects, Bureau of Indian Affairs (BIA) or Federal Highway Administration (FHWA) Tribal Transportation Program. Experience working with Federal grants and programs. Experience with Quick Books. TERO preference.

Transportation Division Head 

TASKS: • Represents the Fort McDowell Yavapai Nation in all criminal, juvenile, dependency and/or comparable actions; • Represents the Fort McDowell Yavapai Nation in all appeals of all criminal and juvenile actions; • Reviews reports and complaints to determine if court action should be filed; • Prosecutes violations of tribal laws and ordinances and negotiates plea agreements; • Researches and prepares legal pleadings, argues motions and appeals and formulates trial strategies; • Researches technical and scientific aspects of evidence; • Interviews and prepares witnesses to testify at trial; • Contacts defense attorneys or unrepresented defendants regarding pending cases and collects and provides discovery to the defense • Responds to police and other enforcement personnel requests for information as requested; • Advises police or other enforcement personnel on legal matters and procedures; • Provides legal assistance to prosecuting staff and other tribal attorneys as requested; • Monitors court scheduling of cases and maintains case logs and prosecution statistics; • Provides limited assistance to the general public by answering limited questions; • Researches existing laws/ordinances; • Performs other duties as assigned or required.

Fort McDowell Yavapai Nation 

DEFINITION/PURPOSE: Prosecutes criminal, traffic, juvenile and comparable cases in Tribal Court.

KNOWLEDGE/SKILLS: • Working knowledge of the Fort McDowell Yavapai Nation Constitution, Law and Order Code, Arizona Revised Statutes, Federal Indian Law, Indian Civil Rights Act, Indian Child Welfare Act, Tribal Case Law, Federal Rules of Evidence; • Knowledge of court protocol, proceedings, and practices; • Knowledge of legal research utilizing books and electronic research systems; • Skill in interpreting and applying complex laws, statutes, ordinances, and rules; • Skill in managing a high case load consisting of a variety of case types; • Skill in operating a personal computer with word processing software; • Skill in establishing and maintaining effective and cooperative working relationships with other departments of the Fort McDowell Indian Community. 

MINIMUM QUALIFICATIONS/EDUCATION: 1) A law degree from an accredited law school and Membership in the State Bar of Arizona; 2) Three years of responsible experience in criminal prosecution or defense of criminal cases including jury trials; 3) Tribal experience desirable; 4) Juvenile court experience desired 5) Drug court experience desired 6) Current Arizona driver’s license and ability to meet insurance standards, 7) Experience with electronic legal research

Deputy Prosecutor 

Yakama Nation represent in prosecution of adults committing criminal acts and juveniles committing delinquent acts within the tribal jurisdiction.

Represent the Yakama Nation in civil actions involving child abuse/neglect, in civil ICWA proceedings.

Draft notices of intervention and/or petitions to transfer which represents the best interests of the child(ren) and the tribe as provided under tribal and federal law.

Represent the Yakama Nation in civil prosecution of traffic offenses, fish & wildlife offenses, exclusion matters, and other Titles under the RYC wherein the Yakama Nation is the plaintiff as allowed under RYC 3.01.29.

Advise the Tribal Police, NNWS and CPS in investigation, evaluating evidence, case preparation and preparation of legal pleadings including; subpoenas, search warrants, arrest warrants, and pick up Orders/Detention Orders.

Work with and refer cases as appropriate to the U.S. Attorney's Office for federal prosecution or the County Prosecutor for state prosecution of non-Indian offenders.

Conduct all necessary case preparation before Tribal Court hearings and trials, including drafting and filing written complaints, motions, proposed orders, legal briefs, jury instructions, sentencing/release recommendations, and other legal documents as appropriate.

Zealously argue and present cases as appropriate in Tribal Court and Tribal Court of Appeals.

Train and consult with the Tribal Police and other agencies as appropriate regarding tribal justice and victimization issues.

Assist in a variety of department operations; perform special projects and assignments as requested or directed by the Justice Services Administration Office, including code revisions.

Present and explain key policy issues regarding tribal justice and victimization through written and/or oral reports to key stakeholders that include the JSA, Tribal Administration, and/or Tribal Council/General Council.

Prepare and distribute education and outreach materials, which may include organizing and/or attending community events, forums, and trainings.

Ensures the availability of 24-hour legal support services to Tribal Police, CPS and ICWA agencies.

Abide by Yakama Nation Rules and Regulations.

Knowledge of standard court procedures, rules of evidence, and application of prosecutorial best practices for both civil and criminal cases.

Knowledge of all relevant aspects of questions of law related to Federal, State and Tribal law as it relates to Indian Treaties, Indian Civil rights, Indian property, and Tribal sovereignty to determine its applicability.

Knowledge of the Revised Law and Order Code of the Yakama Nation

Knowledge of Yakama Nation administrative manuals (Yakama Nation Personnel Policy Manual, Supervisor's Handbook, etc.).

Knowledge of effective administrative office management and supervision principles, practices and processes.

Knowledge and application of Yakama Tribal governmental operations and applicability of Committee Actions, Tribal Council Resolutions, and General Council Resolutions.

Knowledge of traditional Yakama Tribal laws and practices as they pertain to the Yakama Traditional hearings and Tribal Court practices.

Ability to conduct legal research, evaluation of legal complexities concerning cases, and the analysis and preparation of cases, briefs, reports, resolutions, narratives, and testimony.

Yakama Nation 

Employee serves as the Chief Prosecutor and Chief Legal Officer for the Confederated Tribes and Bands of the Yakama Nation to defend the Treaty of June 9, 1855 (12 Stat. 951) and the inherent sovereignty of the Yakama Nation by seeking enforcement of duly enacted Tribal laws. The primary goal for the Prosecutor's Office is to improve safety in its communities by working to prevent and reduce criminal activity and victimization on the Yakama Reservation, including the Usual and Accustomed territories, through vigorous and effective prosecution of civil and criminal cases in both the adult and juvenile courts.

The Chief Prosecutor works with Public Safety, CRITFC, Indian Child Welfare Programs, Probation Services, Youth Court Services, Office of Legal Counsel and other tribal programs and/or agencies to help assess tribal interests, jurisdiction, and provide vigorous and effective prosecution of crimes, juvenile delinquency and status offenses, child abuse/neglect, fish and wildlife offenses, traffic violations/offenses (and infractions as determined by the Courts), exclusion matters, and other appropriate civil or criminal offenses occurring within tribal jurisdiction. The Prosecutor's Office provides legal support to the Tribal Police Department, Nak-Nu-We-Sha (NNWS), State Child Protective Services (CPS), Probation, Youth Court Services Program, and other tribal regulatory and service providing programs in submitting, supporting, or presenting our cases in Tribal Court. Maintains contact with attorneys and other jurisdictions regarding tribal, state, and federal court matters affecting the Yakama Nation.

The Chief Prosecutor is expected to independently present and perform attorney functions in the Tribal and State Courts on behalf of the Yakama Nation. Administratively, the employee is responsible for establishing goals and objectives, budgets, monthly, quarterly and annual reports, staff supervision and development. The employee participates in meetings or projects relative to the Yakama Tribal justice system.

Graduation from an accredited School of Law with a Juris Doctorate degree and must be an active member in good standing with the Washington State Bar and the Yakama Nation Tribal Courts and eligible to practice before the Courts of any other State of the United States.

Possess five or more years of experience in professional legal work with an emphasis on prosecution services.

Required to pass pre-employment drug test.

The Nez Perce Tribe Department of Law & Justice is recruiting for: 

CHIEF JUDGE [HR-25-151] (Full-time/Lapwai). 

This position requires a wide range of legal, administrative, management and budgetary skills. The Chief Judge presides over the Tribal Court, and hears, or assigns to other Tribal Court Associate and Pro-Tem judges, all cases heard in the Tribal Court. Handles all phases of civil and criminal litigation, drafts orders, opinions, memoranda and other legal documents, and fulfills all other duties required of the Chief Judge to assure an effective and fair Tribal Court. In addition, supervises Associate Judges, and Court Administrator. 

Requires three (3) years’ judicial experience or ten (10) years’ experience in active practice of law, preferably in a Tribal Court, and three (3) years of supervisory experience. Evidence of success in court administration and court budget development is preferred. Applicants must demonstrate that they have a thorough knowledge of Indian law, the Nez Perce Tribal Code, and applicable federal law, including but not limited to the Tribal Law and Order Act and Violence Against Women Act. Must have a Juris Doctor from an accredited law school and must be a member in good standing of a state bar. This is a four (4) year contract position with generous salary and benefits.
